The General Assembly of United Nations, reaffirming it’s previous commitments on HIV/AIDS, adopted Declaration of commitment in 2001 to address the problems of HIV/AIDS by intensifying efforts globally to combat it. The Republic of India, being a signatory to the declaration, it was expedient to give effect to aforesaid declaration by enacting HIV/AIDS (Prevention and Control) Act-2017.

The Government of Gujarat has made the HIV/AIDS (Ombudsman and Legal Proceedings) rules 2021 to implement the said act.

The Office of the Ombudsman, Regional Deputy Director’s Office (Health & Medical Services-Department of Health and Family Welfare, Government of Gujarat) functions to fulfill the applicable goals and objectives of the said act and the rules.

Goal :

To protect human rights of persons affected by HIV/AIDS and for matters connected therewith or incidental there to.

Objectives :

  • To protect and secure the human rights of persons who are affected by HIV/AIDS & rectification of violation of this act as reflected in section (3) & (24) of the said act.
  • Direction to the concerned authorities to provide admission and treatment to affected HIV/AIDS patient in case of medical emergency.
  • To Protect the rights of health care providers and others persons in relation to HIV/AIDS.
